China's Ministry of Commerce clarified on Oct. 23 that its pending artificial intelligence export controls exempt overseas application programming interface services, keeping cross-border cloud access outside regulatory limits.

The carve-out targets application programming interfaces (APIs) — software bridges that let external programs query remote models without viewing raw code. The draft covers 23 AI technologies among 40 items added across three industrial sectors.

The joint draft with the Ministry of Science and Technology, published as Announcement No. 48, restricts foundation models exceeding 2 trillion parameters or 10^26 training FLOPs — floating-point operations measuring computing scale — from physical transfer abroad.

Under the draft rules, weight checkpoints, training scripts and model architectures cannot leave domestic servers without a state export licence. However, remote queries processed entirely inside Chinese data centers will face no such restriction.

The distinction separates physical intellectual property transfers from commercial network services. Regulators designed the framework to safeguard core model architecture while preserving global developer adoption for Chinese artificial intelligence systems.

By keeping cloud endpoints accessible to international developers, Beijing seeks to embed its software stacks into enterprise workflows across Southeast Asia, Europe and Latin America without risking the loss of underlying model weights.

The policy structure directly affects Chinese technology conglomerates that have built extensive cloud infrastructure abroad. Alibaba Group operates data centers across 30 regions globally, where its cloud division generated 29.6 billion yuan ($4.1 billion) last quarter.

Alibaba Group also oversees the open-weight Qwen model series, which has recorded more than 40 million downloads worldwide. The company will now route international enterprise clients through centralized cloud instances rather than local installations.

Baidu faces similar operational adjustments for its Ernie foundation models. External commercial applications submitted more than 200 million daily API queries to Baidu systems during the second quarter, representing roughly 11% of its enterprise cloud revenues.

DeepSeek, an artificial intelligence laboratory backed by hedge fund High-Flyer, gained international traction by releasing open-source models with 671 billion parameters. Its overseas user base will retain access through standardized API calls hosted in mainland clusters.

Tencent Holdings has likewise expanded API distribution for its Hunyuan model family. Tencent Cloud signed enterprise contracts covering more than 1,200 overseas corporate clients last year, accounting for nearly 6% of its overseas cloud infrastructure receipts.

Restricting raw model transfers prevents foreign competitors from fine-tuning Chinese base models on private hardware. That barrier preserves domestic control over proprietary alignment techniques and synthetic data recipes, industry analysts said.

The draft also restricts software agents managing over 200 external tools with task success rates above 90%, or those chaining 20 consecutive steps. These controls aim to prevent advanced cyber-defense and military planning automation from crossing borders.

Open-source software releases receive dedicated treatment in the ministry's regulatory framework. Technologies that have already entered the public domain through open academic publishing or repository releases remain fully exempt from the export restrictions.

For restricted AI technologies slated for future open-source release, the commerce ministry outlined an automatic licensing channel. The fast-track mechanism aims to encourage global developer engagement while ensuring Beijing maintains administrative oversight.

The strategic approach mirrors earlier dual-track export controls implemented in telecommunications and renewable energy. Beijing previously encouraged overseas hardware exports while restricting the transfer of underlying ingot manufacturing and wafer slicing techniques.

South Korean artificial intelligence startups that incorporate Chinese open models into proprietary translation engines are reassessing their engineering pipelines. Local software houses must now decide whether to host domestic copies or switch to remote endpoints.

Japanese robotics and automation manufacturers that use Chinese computer vision models for factory inspection face similar questions. Deploying weights directly inside factory edge devices may require regulatory filing, whereas cloud API calls will remain exempt.

The commerce ministry has established a formal public consultation window running through Nov. 15, 2026. Domestic technology enterprises and industry associations have begun submitting technical feedback on model evaluation metrics and agent threshold definitions.

A mandatory interim registration system for the 40 targeted technologies took effect immediately upon publication on Oct. 16. Domestic entities attempting unapproved cross-border transfers of covered source code face commercial administrative penalties.

The ministry has not published a separate formal directive dated Oct. 23, and the underlying notice does not specify how regulatory agencies will audit parameter counts in multi-modal architectures.

The State Council will review the final catalogue revisions following the closure of the public comment period in November. Exporters of restricted computing clusters and foundation models must file transactional records before completing foreign contracts.
